Terms of service
These Terms of Service ("Terms") are an agreement between you and IFC LLC — Investment Fidelity Company LLC, a Florida (USA) limited liability company ("IFC", "we", "us") — covering the Sky Peck game, the skypeck.fun website, and the related account, licensing, and leaderboard services (together, the "Service"). By creating an account, buying a license, or using the Service, you agree to these Terms and to our Privacy Policy and Refund Policy, which are part of them. If you don't agree, please don't use the Service.
We've tried to keep these readable. Plain-language summaries aren't a substitute for the sections themselves, but the short version is: one purchase, five devices, yours for good; accounts are for adults; be decent on the leaderboard; don't pirate the game.
1. Who can use Sky Peck
Accounts are for adults. You must be at least 18 years old (or the age of majority where you live) to create an account or buy a license. Kids play the game — on a parent's or guardian's license, under their supervision — but children do not create accounts, and we don't knowingly let them. Everything account-related (purchases, device approval, leaderboard settings) is designed to be done by the adult who owns the account.
2. Beta access and invitations
During the beta, account sign-up is invite-only. Invitation codes are personal: don't post them publicly or sell them. Some invitations include a complimentary license; comped licenses follow the same rules as purchased ones except that no refund applies (there's nothing to refund). The beta version of the game may have bugs, and features may change or be removed as we build. We may end the beta or convert beta accounts to regular accounts at any time.
3. Your account
You need an accurate email address to register, and you must verify it before buying. Keep your password confidential — you are responsible for activity that happens under your account. Tell us right away at hello@skypeck.fun if you think someone else has accessed it. One account per person; you may not create accounts by automated means or impersonate anyone.
4. Buying a license
A Sky Peck license is a one-time purchase — currently $14.99 USD — not a subscription. There are no recurring charges and the license does not expire. Prices may change, but a change never affects a license you already bought. Prices may not include applicable sales tax or VAT, which is calculated at checkout where required.
Payments are processed by Stripe, Inc. By paying for a license, a donation, or any other service, you agree to Stripe's Consumer Terms of Service and Privacy Policy, and you authorize Stripe to charge your chosen payment method. Your card details go directly to Stripe and never touch our servers; we receive confirmation that a payment succeeded, the amount, and basic order details — never your card number.
Promotion and discount codes may be offered from time to time. They are single-purpose, may expire or be withdrawn, and can't be exchanged for cash. If you arrived through a referral link, the referral may be recorded with your order so we can credit the person who referred you — this never changes the price you pay.
5. Your license (the game license)
When you buy a license, we grant you a personal, non-exclusive, non-transferable license to install and play Sky Peck on up to 5 devices for personal, non-commercial use by you and members of your household. The game is licensed, not sold: you own your license, and we own the game.
- Devices. Your license covers 5 active devices at a time. You can add and remove devices from your account. Removing a device from the website frees the seat immediately; the removed device loses access when it next checks in or its offline token expires (about 30 days at most). To prevent abuse, device swaps are limited to a reasonable number per month.
- Offline play. An activated device stores a signed offline token so the game works without an internet connection. The game periodically refreshes this token when online. We never lock the game mid-session; changes to license status take effect at the next launch.
- What you may not do.Don't sell, rent, lend, or transfer your license or account; don't share license access outside your household; don't copy, modify, or distribute the game; don't reverse engineer, decompile, or bypass the licensing system except where the law expressly permits it despite this clause; don't use the game or Service for anything unlawful.
- Revocation.We may revoke a license in cases of fraud, chargebacks, refunds, or serious breach of these Terms. A revoked license puts the game into free demo mode — it never bricks the download. If we revoke in error, contact us and we'll fix it.
The free demo tier (no account or license) and the registered tier (account, no license) are provided under the same rules, minus the purchase-related ones.
6. Refunds
You have a 14-day no-questions refund window on license purchases, described in full in the Refund Policy. Refunding revokes the license and the game returns to demo mode on your devices. Initiating a chargeback instead of asking us for a refund may also result in license revocation — please just email us; we're fast and friendly about it.
7. Leaderboards and nicknames
Leaderboard uploads are off by default and controlled from the parent account. When enabled, only a nickname, level identifier, and score are uploaded — never video, images, or real-world information. You choose the nickname; don't use a child's real name, anything identifying, or anything offensive. We moderate the leaderboard and may edit or remove entries and suspend leaderboard access at our discretion, particularly for offensive nicknames or cheated scores. Scores submitted by tampering with the game or the API may be removed and may lead to account termination.
8. Acceptable use
When using the Service, you agree not to:
- probe, scan, overload, or disrupt the Service or access it by any automated means (except ordinary search-engine indexing of public pages);
- attempt to access another person's account, licenses, or data;
- forge scores, manipulate the device-activation system, or circumvent purchase, invitation, or referral mechanics;
- resell, sublicense, or commercially exploit the game or Service without our written permission.
9. Play safely
Sky Peck is played with your whole body — spreading arms, leaning, flapping. Before playing, clear the play area of obstacles, keep a safe distance from screens and furniture, and supervise young children. Stop and rest if anyone feels dizzy or tired. Like other games, Sky Peck contains moving imagery that could, in rare cases, affect people with photosensitive conditions — consult a doctor if you or your child has a history of seizures. You are responsible for providing a safe play space.
10. Our content and yours
The game, its art, music, code, and the website content are owned by IFC LLC or its licensors and protected by copyright and other laws. These Terms don't give you any rights in them beyond the license described above. The names "Sky Peck" and our logos may not be used without permission. If you believe content on the Service infringes your copyright, email hello@skypeck.fun with details and we'll respond promptly.
Feedback is welcome and free: if you send us ideas or suggestions, we may use them without obligation to you.
11. Third-party services
The Service is built on services from third parties — payments by Stripe and hosting and email delivery by Amazon Web Services. Their availability affects ours, and your use of Stripe's checkout is subject to Stripe's terms. If you buy Sky Peck through a third-party store in the future (for example a game storefront), that store's terms and refund process govern the purchase itself, while these Terms still govern the game.
12. Ending things
You can stop using the Service and delete your account at any time — from your account page, from the standalone account deletion page without signing in, or by emailing hello@skypeck.fun. Deleting revokes any license and forfeits any refund you hadn't yet claimed. We may suspend or terminate accounts that seriously or repeatedly breach these Terms; where practical, we'll warn you first and give you a chance to fix it. Sections that by their nature should survive termination (like ownership, disclaimers, and liability limits) survive it.
13. Warranties and liability
We work hard on Sky Peck, but the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't promise the Service will be uninterrupted or error-free.
To the maximum extent permitted by law: we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data; and our total liability for all claims relating to the Service is limited to the amount you paid us in the 12 months before the claim arose (or $15 if you paid nothing). Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you — nothing here limits rights that consumer-protection law gives you and that can't be waived, and nothing excludes liability that cannot legally be excluded.
You agree to indemnify us against third-party claims arising from your breach of these Terms or misuse of the Service, to the extent caused by that breach or misuse.
14. Changes
We may update the game (content, features, balance) and these Terms over time. If we make a material change to the Terms, we'll post the updated version here with a new date and, for significant changes, notify account holders by email. Continuing to use the Service after a change takes effect means you accept it; if you don't, stop using the Service and contact us — if a material change to a paid feature genuinely harms you, we'll work out a fair resolution, including a refund where appropriate.
15. Governing law and disputes
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules, and disputes will be resolved in the state or federal courts located in Florida — except that you may always rely on the mandatory consumer-protection rules of the place where you live. Before filing anything, please email us; almost every problem is faster to fix over email.
16. The fine print
These Terms, the Privacy Policy, and the Refund Policy are the entire agreement between you and us about the Service. If part of these Terms is found unenforceable, the rest stays in effect. If we don't enforce a provision, that isn't a waiver. You may not assign these Terms; we may assign them as part of a merger, acquisition, or sale of assets, in which case your license survives.
